1. Acceptance
By using this website, creating an account, or placing an order, you agree to these terms. If you do not agree, do not use the service.
2. What we are
Food Permit Experts is an independent permit-assistance service and is not affiliated with or endorsed by the Texas Department of State Health Services, the Texas Alcoholic Beverage Commission, or any other government agency. Permit eligibility, approval, fees, inspections, and timelines are determined by the applicable government authority.
We are not a law firm and we do not provide legal advice. Nothing on this site or from our staff is legal advice. If you need legal advice, consult a licensed attorney.
3. What the service is
We provide permit-assistance services: reviewing your information, identifying the applicable permit type and authority, preparing and submitting applications, responding to correction requests, providing inspection-preparation guidance, and keeping you informed through your portal until the application is resolved.
We do not issue permits and we cannot guarantee approval. Eligibility, approval, denial, fees, inspections, and timelines are determined solely by the applicable government authority.
4. Fees and payment
- Our service fee is the amount stated on the site at the time you order, charged per permit-assistance order.
- Payment is processed by Stripe. By paying you also accept Stripe’s terms.
- Government, inspection, licensing, filing, and late fees are separate, are set and collected by the applicable authority, and are your responsibility.
- Discount codes are validated at checkout and may carry eligibility, expiration, and redemption limits.
- Fees may change; the price displayed when you order governs that order.
5. Your responsibilities
You agree to provide complete, accurate, and truthful information; submit requested documents promptly; pay government fees when due; follow the instructions we provide; cooperate with inspections and government requests; keep your account credentials secure; and promptly tell us about changes affecting your application.
Providing false or misleading information may cause your application to be denied, may void our guarantee, and may carry consequences imposed by the authority.
6. Guarantee and refunds
Our guarantee and refund terms are set out on the Guarantee page, which forms part of these terms. Refunds of our service fee are issued to the original payment method. Government fees are not refundable by us.
7. Accounts and portal
- An account is not required to place an order. After a verified payment we may create an account for the email address used at checkout and send a secure, single-use activation link.
- You are responsible for activity under your account. Notify us immediately of unauthorized use.
- We may suspend or disable an account for suspected abuse, fraud, or violation of these terms.
- Our staff cannot see, choose, or retrieve your password. Password resets are always self-service through a secure emailed link.
8. Documents you upload
You represent that you have the right to provide the documents you upload and that they are accurate. You grant us permission to use them for the purpose of preparing, submitting, and supporting your application, including sharing them with the applicable authority.
Once submitted materials enter processing, they are retained as part of the order record and cannot be deleted on request, because they document what was filed on your behalf. You may upload a replacement version at any time.
9. Acceptable use
You may not use the service to submit fraudulent applications or false information; attempt to access another customer’s data; probe, scan, or test the security of our systems without written authorization; upload malicious files; interfere with the service; or scrape or resell our content.
10. Intellectual property
The site, its content, branding, and software are owned by Food Permit Experts or its licensors. You may not copy, reproduce, or create derivative works without written permission. You retain ownership of the documents and information you provide.
11. Disclaimers
The service is provided “as is” to the fullest extent permitted by law. We do not warrant that a permit will be issued, that a government authority will act within any timeframe, that the site will be uninterrupted or error-free, or that information about government requirements — which change — is complete or current at all times.
12. Limitation of liability
To the fullest extent permitted by law, our total liability arising out of or relating to the service is limited to the amount of the service fee you paid for the affected order. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost business opportunities, event cancellations, or costs of vehicles, premises, or leases.
This clause has significant legal effect and must be reviewed by counsel.
13. Indemnification
You agree to indemnify and hold harmless Food Permit Experts and its staff from claims arising out of information you provided, your operation of a regulated business, or your violation of these terms or applicable law.
14. Governing law and disputes
These terms are governed by the laws of the State of Texas without regard to conflict-of-laws rules. Venue lies in the state or federal courts located in Texas.
The owner should decide with counsel whether to add arbitration, class-action waiver, or a specific county for venue.
15. Changes
We may update these terms. The version in effect when you placed an order governs that order. Continued use after changes constitutes acceptance.
